What are the main differences in the composition of the apex court in India and in UK ?  



i. India - Supreme Court comprises the Chief Justice and 26 other companion Judges appointed by the President of India. Parliament has the power to make laws regulating the constitution, organisation of the jurisdiction and powers of the Supreme Court. The number of judges can be increased as well as decreased by Parliament. Originally there was a provision in the Constitution that there will be Chief Justice and seven other judges.This number (7) was raised to 10 in 1956, 13 in 1960, 17 in 1977 and 25 in 1985 (Article 124).

ii. UK - The Supreme Court of the United Kingdom (SCUK) is the final court of appeal in the UK for civil cases, and for criminal cases from England, Wales and Northern Ireland. It hears cases of the greatest public or constitutional importance affecting the whole population.

The Constitutional Reform Act 2005 made provision for the creation of a new Supreme Court for the United Kingdom. There had, in recent years, been mounting calls for the creation of a new free-standing Supreme Court separating the highest appeal court from the second house of Parliament, and removing the Lords of Appeal in Ordinary from the legislature. On 12 June 2003 the Government announced its intention to do so.

Before the Supreme Court was created, the 12 most senior judges – the Lords of Appeal in Ordinary, or Law Lords as they were often called – sat in the House of Lords. The House of Lords was the highest court in the land – the supreme court of appeal. It acted as the final court on points of law for the whole of the United Kingdom in civil cases and for England, Wales and Northern Ireland in criminal cases. Its decisions bound all courts below.
